Alabama State Bar Issues Formal AI Ethics Opinion — 21 Jurisdictions Now Have Guidance

The Alabama State Bar issued Formal Opinion 2026-01 on August 4, joining a national consensus now documented across 21 jurisdictions. The opinion frames AI ethics not as new obligations but as a recontextualization of existing professional conduct rules — competence, confidentiality, supervision, communication, candor, and reasonable fees — for AI-assisted practice. The most operationally significant guidance for mid-sized firms: deploying an AI tool without basic due diligence on how it works and what it can get wrong does not satisfy Rule 1.1; chatbots providing specific legal advice on firm websites without attorney review may constitute unauthorized practice of law under Rules 5.5, 5.3, and 8.4; and if AI substantially reduces the time needed to complete a task, billing practices must adjust accordingly. The national law review analysis framing the opinion as a "practical roadmap for AI governance" is apt — the seven-step inventory and policy framework it recommends maps directly onto the concerns driving law firm AI governance failures.
