The Client-Facing AI Disclosure Gap Is Becoming a Panel Risk

The Legal Stack's "Legal AI Client-Facing Deployment Report 2026" — published July 1 and this week receiving renewed attention as EU AI Act Article 50 became enforceable — documented a finding that creates direct panel risk: only 31% of engagement letter templates reviewed contained any reference to AI use in client service delivery, and fewer than half of those (approximately 14% of the total sample) specified client-facing AI as distinct from internal research or drafting assistance. Among corporate respondents (legal ops professionals and GCs at companies with over $100M in revenue), 78% said they wanted explicit disclosure from outside counsel about AI use in client-facing interactions, and 41% reported they would require disclosure as a matter of outside counsel policy going forward. The enforcement clock has now started: EU AI Act Article 50, which requires disclosure when AI systems interact directly with people, is operative as of August 2. For BD and client relationship teams, the practical implication is a short-cycle engagement letter audit and a prepared talking point for client conversations — "here is how we use AI in your matter, and here is what it means for how we bill you" — before the conversation is initiated by the client's legal ops team.
