On October 5, the International Criminal Court unsealed four warrants issued in 2025 for Taliban leaders Haibatullah Akhundzada, Abdul Hakim Haqqani, Habibullah Agha and Neda Mohammad Nadim. The Pre-Trial Chamber said its Rome Statute analysis of gender required an interpretation extending beyond a purely biological conception of sex, while the warrants concern alleged persecution connected with severe restrictions and abuses affecting women, girls and others. The decision does not secure custody, and Taliban authorities reject the Court’s jurisdiction and allegations, but it makes the Chamber’s legal reasoning and factual findings available for other accountability, sanctions and asylum processes. Counsel should distinguish the existence of warrants and judicial findings at the pre-trial stage from a conviction while assessing travel, diplomatic and counterparty implications.
