On October 20, Reuters reported that Gellert Global Group sued in the U.S. Court of International Trade to block 50% tariffs on a range of Canadian imports imposed under Section 338 of the Tariff Act of 1930. The complaint argues that later statutes superseded or constrained the provision, which Reuters described as having no known prior use in nearly a century; the $1.7 billion-revenue importer is seeking class treatment for similarly affected businesses. Cross-border clients should not assume the litigation will quickly remove the duties, but they should preserve protest rights and review tariff, change-in-law and price-adjustment provisions. The second-order risk is continued cycling among statutory authorities, leaving supply-chain economics exposed even when courts reject a particular presidential theory.
