Judge vacates EPA’s termination of the $7 billion Solar for All program

On September 18, Reuters reported that US District Judge Mary McElroy ruled that the EPA exceeded its authority when it terminated $7 billion in already-awarded Solar for All grants and vacated the cancellation. The program had made 60 awards in 2024 to states, tribes and nonprofits, with the agency then projecting service to nearly one million households; the EPA said it was considering an appeal, while related claims remain pending in the Court of Federal Claims. The ruling makes grant language, statutory authority and reliance interests central to climate-program risk rather than treating an administration change as dispositive. Recipients and financing partners should preserve award records and model appeal and cash-flow scenarios because the judgment restores the program but does not end the wider litigation.
