SpaceX land swap proceeds after court denies preliminary injunction

On September 22, the Associated Press reported that US District Judge Fernando Rodriguez Jr. declined to preliminarily block a federal land swap giving SpaceX more than 700 acres from a South Texas wildlife refuge in exchange for 683 acres elsewhere. The court concluded at this preliminary stage that environmental groups had not shown the exchange created a greater ecological risk, while the Fish and Wildlife Service said the deal would produce a net conservation benefit. The decision permits the transaction to proceed but does not resolve the underlying claims, so project counsel should not treat it as final validation of the environmental analysis. For companies pursuing public-land exchanges, the record shows that comparative habitat evidence and agency explanations can determine whether opponents obtain early injunctive relief.
