Tenth Circuit proposes human-review certification for AI filings

On September 18, Reuters reported that the US Court of Appeals for the Tenth Circuit proposed requiring lawyers to certify that every filing received human review and that AI-generated content was independently verified. The rule is proposed to take effect on January 1, 2027, with comments due October 18 and a final decision planned for December 1; failures could trigger waiver or striking of a filing in addition to sanctions already available. For legal-tech vendors, this turns human review and verification from general risk language into a workflow event that products may need to document. Filing tools should make source checking, reviewer identity and approval history exportable rather than assuming a user’s final click provides a sufficient audit trail.
