GSA narrows its final LLM procurement clause before October 19 effectiveness
Inside Practice · OCTOBER 5, 2026 · 1 MIN READ
On September 28, 2026, the U.S. General Services Administration issued final clause 552.239-7001 for government procurements in which LLM functionality is a material feature and government data is submitted to or produced by the model; Crowell & Moring analyzed the change on October 2. The clause becomes effective October 19, 2026, narrows incident-reporting triggers, preserves more pre-existing contractor IP and restructures subcontractor flow-down around NIST AI Risk Management Framework tasks. It also leaves the government with suspension and decommissioning remedies, while capping decommissioning liability at 25% of the affected task or delivery order according to the legal analysis. Legal-tech companies selling into federal agencies should map data flows, subcontractors, incident reporting and commercial terms now, because the compliance burden attaches to delivery architecture rather than to a generic AI label.
